Brisbane 26 December 2014. As thousands of Queenslanders flock to the Boxing Day sales, it is important to be familiar with consumer refund rights before spending big.
Acting Attorney-General and Minister for Justice John McVeigh said eager shoppers should avoid making impulsive purchases as they may not be able to get a refund or exchange.
“Boxing Day is a great opportunity to grab a bargain, but refunds are not automatic and can only be given when there is something wrong with the purchased product,” Mr McVeigh said.
“If a product is broken or unsafe, it is the responsibility of the retailer to fix the problem by either offering a refund, repair or replacement.
“If a customer changes their mind because they have found an item cheaper elsewhere or bought the wrong size or colour, the business does not have to issue a refund.
“While some businesses do offer refunds in this situation as a sign of goodwill, they are not legally obligated to and so it’s a good idea to check refund and exchange policies before buying.
“If a refund is given, a business will usually issue it via the same payment method used in the initial transaction.”
Mr McVeigh said consumer laws guarantee the goods consumers buy:
- are of acceptable quality
- are fit for purpose
- match any description given or any sample shown
- satisfy any extra promises made about them
- are safe
- have no money owing on them
- will have spare parts available for a reasonable period of time
“Services also have standards to meet, including whether they are provided with due care and skill, whether they fit the specified purpose and whether they are provided within a reasonable time when no specific time has been set,” he said.
“The Newman LNP Government is committed to ensuring all Queenslanders are aware of their consumer rights and are protected at Christmas time and throughout the year.”
