October 10, 2013 /24-7PressRelease/ -- Many drivers in Detroit have probably experienced being tailgated by someone, or being narrowly cut off by another driver changing lanes, resulting in feelings of intense anger and frustration. There are many incidents that can happen to make a driver feel that they are a victim of aggressive driving or road rage. What many people don't realize is that there is a difference between the two, though they may result in some of the same outcomes, such as motor vehicle accidents, traumatic injuries and even death.

Aggressive Driving Traffic OffensesThe National Highway Traffic Safety Administration describes aggressive driving as a series of traffic offenses that may endanger people or property. In Michigan these offenses are most similar to the Careless Driving statute. Careless driving and aggressive driving are similar in that they refer to hazardous and negligent driving behavior. Some driver behaviors that are categorized as aggressive are:- Tailgating or following too closely.- Driving faster than the speed limit posted.- Running red lights.- Improper changing of lanes.- Failing to obey traffic control signs and signals.

Road Rage DefinedAccording to the Michigan State Police road rage is considered to be a criminal offense, being similar to Michigan's reckless driving statute, as it refers to an intent crime where the driver is willful in their disregard for the safety of other motorists. The NHTSA defines road rage as an assault with a motor vehicle occurring on a roadway.

An incident of road rage was reported recently in Coldwater, Michigan, according to a WTVB report. A man was believed to have been driving aggressively, tailgating a woman who then slammed on her brakes, which caused the man to change lanes suddenly. She claimed that he pulled up alongside her and screamed at her. The incident could have turned deadly as she had a hand gun in her possession that she had pointed at the motorist as she said she was afraid of his aggressive driving. Similar motorist encounters have been reported in several states.

Aggressive Driving a Precursor to Road Rage

Many people respond to aggressive driving with aggression, such as honking, yelling, and obscene gestures. Aggressive responses can fuel the interaction and often escalate the situation to road rage. To prevent this from happening there are a few things that drivers can do to avoid an accident and engaging in road rage, such as to stay calm, avoid eye contact and non-verbal communication with the other motorist and allow the aggressive driver to pass.

Ultimately, any driving behavior of a motorist in Detroit that is careless, negligent and compromises the safety of others, damages property, or endangers someone, may be a violation of the Michigan statutes. Anyone who has suffered injuries as a result of a car accident due to aggressive driving or road rage, should consult with an attorney to learn about their rights and how they may seek compensation for their injuries.
